1. Acceptance of Terms

By downloading, installing, or using the Sweet Merge mobile application or visiting sweetmerge-app.com ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use the Service. These terms constitute a legally binding agreement between you and Sweet Merge.

2. Eligibility

You must be at least 18 years of age to use Sweet Merge. By using the Service, you represent and warrant that you are 18 or older. We reserve the right to terminate your account if we determine you are under the age of 18. The Service is intended for use in Australia.

3. Nature of the Service

Sweet Merge is a free-to-play social entertainment application. It is not a gambling service. No real money is wagered, and no real monetary prizes can be won. All in-game virtual currencies, coins, gems, and items:

• Are for entertainment purposes only;
• Have no real-world monetary value;
• Cannot be exchanged for cash, prizes, or any item of real-world value;
• Are non-transferable and may not be sold, traded, or gifted outside the app.

4. Account Registration

You may be required to create an account to access certain features. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. User Conduct

When using Sweet Merge, you agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws;
• Attempt to hack, reverse-engineer, or disrupt the Service;
• Use cheats, exploits, automation software, bots, or any unauthorised third-party software;
• Harass, threaten, or abuse other users;
• Distribute harmful, offensive, or illegal content through the app;
• Impersonate any person or entity;
• Circumvent any security features of the Service.

6. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, audio clips, and software — are the exclusive property of Sweet Merge and are protected by Australian and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial entertainment purposes only.

7. In-App Purchases

The Service may offer optional in-app purchases of virtual currency or items. All purchases are final and non-refundable except as required by Australian Consumer Law. In-app purchases provide virtual items only and confer no rights to real money or prizes.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. To the extent permitted by Australian law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by Australian law, Sweet Merge shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the Service. Nothing in these terms limits any rights you may have under the Australian Consumer Law.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Australia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Australia.

11. Modifications

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "last updated" date. Continued use of the Service after changes constitutes acceptance of the new terms.
